The rules, in plain English

Terms of Use

Last updated October 2026. These terms apply to everyone who browses, posts or messages on CayMarket. By using CayMarket you agree to them.

Draft, for review by a Cayman-licensed attorney before launch.

01What CayMarket is (and isn't)

CayMarket is an online marketplace and classifieds platform for the Cayman Islands, where people and businesses post and find listings across property for rent and sale, autos and boats, jobs, services, items for sale and community notices. We provide the listing pages, search, the map, the in-app chat and tools such as the property calculator.

We are not a party to any sale, rental, hire, booking, employment or other agreement made through CayMarket, and we are not a real-estate agent, broker, dealer, employer, landlord, auctioneer or adviser. Every transaction or arrangement is strictly between the users involved. We do not own, inspect, verify, endorse or guarantee any listing, item, property, service, price or user, and we do not hold funds, collect payment or deliver anything.

02Eligibility and your account

You must be at least 18 years old to create an account or post on CayMarket. You agree to register with accurate information, including a real email address and, if you provide one, a real phone number, and to keep your password confidential. You are responsible for all activity that happens under your account.

One person, one account. Accounts created to evade a suspension, impersonate another person or business, or run scams will be removed, and we may refuse or withdraw service to anyone.

03Posting and listing rules

If you post a listing, you confirm that:

  • the listing is genuine, located in or relevant to the Cayman Islands, and in a category that fits what you are offering;
  • you own the item or property, or are lawfully authorised to sell, rent, hire or advertise it;
  • the price, photos, description, availability and all details are accurate and kept up to date;
  • you mark a listing as sold, rented or hidden once it is no longer available.

The following are prohibited anywhere on CayMarket:

  • anything illegal under Cayman Islands law;
  • gambling, betting, lotteries or raffles of any kind, which are illegal in the Cayman Islands;
  • alcohol, tobacco, vaping products, drugs or any other controlled or restricted goods;
  • weapons, firearms, ammunition or explosives;
  • adult, sexual or pornographic content, material or services;
  • counterfeit, stolen or recalled goods, or anything that infringes another person's trademark, copyright or other rights;
  • fake, duplicate or bait listings, and photos or text copied from other people's listings;
  • requests for deposits, "holding fees" or any payment before the buyer or renter has seen the item or property in person;
  • harassment, threats, discrimination or abusive messages in chat;
  • spam, pyramid or multi-level schemes, or advertising unrelated to the Cayman Islands.

04Your content and the licence you give us

You keep ownership of the listings, photos, text and other content you post. By posting it, you grant CayMarket a non-exclusive, worldwide, royalty-free licence to host, store, display, copy, adapt for formatting and thumbnails, and distribute that content so we can operate, improve and promote the marketplace. This licence ends when you delete the content or your account, except for copies kept in routine backups or where the law requires us to retain it.

You confirm you have the right to post your content and that it does not break the law or infringe anyone else's rights.

05Acceptable use

You agree not to:

  • scrape, copy, harvest or bulk-collect listings, contact details or any data from the platform, by bot or otherwise;
  • use automated systems, or access the platform in a way that overloads or disrupts it;
  • reverse engineer, probe, or try to bypass the security or access controls of the platform;
  • use CayMarket or another user's contact details for unsolicited marketing;
  • use the platform for anything unlawful, or to deceive, defraud or harm another person.

06Dealing with other users, and your release

CayMarket is only the place where users find each other. We are not responsible for the conduct, listings, goods, services, payments or agreements of any user, online or offline. You deal with other users entirely at your own risk.

To the fullest extent permitted by law, you release CayMarket from any claim, demand or dispute of every kind arising out of or connected to a transaction or dealing between you and another user. Always meet in person, inspect before you pay, and never send money in advance, see our safety guide.

07Reports and moderation

Every listing has a report option. When a listing receives three independent reports it is hidden automatically pending review. We may also hide or remove any listing, message or account at our discretion if we believe it breaks these terms or puts users at risk, with or without notice.

A "verified" badge means a user has completed our identity check. It is a safety signal, not an endorsement, and it does not make us responsible for that user's conduct.

08Tools and information are not advice

The property and stamp-duty calculator, the market report, and any figures, estimates or information on CayMarket are provided for general guidance only. They are not professional, legal, financial, tax, valuation or real-estate advice, and we do not guarantee their accuracy or that they fit your situation. Always confirm figures with your own attorney, bank, insurer or qualified adviser before you rely on them.

10Fees

Browsing, posting and messaging on CayMarket are currently free. If we introduce paid features (for example promoted listings or advertising) in the future, their price will be shown clearly before you buy, and these terms will be updated.

11Our intellectual property

The CayMarket name, logo, software, design, text and the selection and arrangement of the platform are owned by or licensed to us and protected by law. You may use the platform for its intended purpose, but you may not copy, reproduce, modify or reuse any part of it without our written permission.

12No warranty

CayMarket is provided "as is" and "as available". We work to keep it safe, accurate and running, but to the fullest extent permitted by law we make no warranties of any kind and we do not promise that listings are genuine, that users will behave, that information is accurate, or that the service will be uninterrupted, secure or error-free.

13Limitation of liability

To the fullest extent permitted by Cayman Islands law, CayMarket and the people behind it are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, data, goodwill, income or opportunity, arising from your use of the platform or from any dealing between users.

Our total liability to you for any claim connected to CayMarket is limited to the greater of the fees you paid us in the twelve months before the claim, or CI$100. Nothing in these terms limits any liability that cannot be excluded under Cayman Islands law.

14You indemnify us

You agree to indemnify and hold harmless CayMarket and the people behind it from any claim, loss, liability or expense (including reasonable legal costs) arising from your content, your use of the platform, your breach of these terms, or your dealings with another user.

15Suspending, ending and changing things

You can stop using CayMarket at any time. We may suspend or close accounts that break these terms or put users at risk. We may update these terms as the platform evolves; the date at the top of this page shows the current version, and continued use after a change means you accept it.

These terms are governed by the laws of the Cayman Islands, and the courts of the Cayman Islands have exclusive jurisdiction over any dispute. If any part of these terms is found unenforceable, the rest stays in force, and these terms are the entire agreement between you and us about CayMarket.
